Terms & Conditions of Carriage
Please note: these terms are a plain-English template prepared for our website. They are not legal advice, and they do not replace the conditions printed on our consignment note. 1. Who these terms apply to
These terms apply to transport services provided by Krishna Tech Route Logistics Private Limited ("we", "us") to the person or company booking a consignment ("you"). They apply alongside the conditions printed on the consignment note.
2. Quotes are estimates
Any rate we give before booking — by phone, WhatsApp, email or through this website — is an estimate based on the information you give us. It is not a fixed price and it is not an offer capable of acceptance.
The final freight may differ if the actual weight, dimensions, commodity, pickup point or delivery point turn out to be different from what was described, or if statutory charges, tolls, permits or diesel prices change between quotation and movement.
3. The consignment note is the binding contract
The consignment note (LR / bilty / goods receipt) issued at the time of booking is the contract of carriage between us. Nothing said in a phone call, a WhatsApp message or on this website varies it. Please read it and keep it safe — it is also the document you need for any claim.
4. Transit times are estimates
Any transit time we mention is an honest estimate from experience on that route, not a guaranteed delivery date or time. Road transport in India is affected by traffic, weather, road closures, checkpoints, strikes, festivals, breakdowns and the availability of loading and unloading labour at either end.
We do not accept liability for loss, penalty or consequential loss caused by delay, unless we have separately agreed a guaranteed delivery in writing.
5. Declaring your goods accurately
You must tell us accurately, at the time of booking:
- what the goods actually are;
- their true weight and dimensions;
- their value, where that affects handling or insurance; and
- any special handling, stacking or temperature requirement.
If goods are mis-declared, we may refuse to carry them, unload them, or charge the correct freight for what was actually loaded. Any fine, detention, penalty or damage arising from a mis-declaration is your responsibility.
6. Goods we do not carry
We do not carry hazardous or dangerous goods, explosives, inflammable materials, narcotics, arms and ammunition, live animals, currency, bullion, jewellery, precious stones, or anything whose transport is prohibited by law — unless we have agreed to it in writing in advance and the correct permits are in place.
7. Packing
Goods must be packed well enough to withstand normal road movement, handling and stacking. We are not liable for damage caused by inadequate or unsuitable packing, or for goods loaded by you or on your instructions against our advice.
8. Liability
Our liability for loss of or damage to goods is limited to the extent stated on the consignment note, and in any event is subject to the limits allowed by the Carriage by Road Act, 2007 and the rules made under it.
Unless you declare a higher value at booking and pay any additional charge agreed for it, we do not accept liability for the full commercial value of high-value consignments. Goods are not insured by us. If you want transit insurance, please arrange it yourself, or ask us before booking.
We are not liable for loss or damage caused by an act of God, war, riot, civil commotion, strike, lockout, seizure under legal process, or any cause beyond our reasonable control.
9. Delivery
Delivery is made against the consignment note to the consignee named on it, at the address given. It is the consignee's responsibility to examine the goods at the time of delivery and to record any shortage or visible damage on the proof of delivery before signing.
If the consignee is unavailable, refuses delivery, or the delivery point cannot be reached by the agreed vehicle, we will contact you for instructions. Demurrage, detention and re-delivery charges may apply.
10. Payment
Freight is payable either at booking ("Paid") or by the consignee at delivery ("To-Pay"), as recorded on the consignment note. Where freight is To-Pay and the consignee does not pay, the consignor remains liable for it.
We may exercise a lien over goods in our possession for freight and charges due to us on that consignment or any other.
11. Claims
Any claim for loss, shortage or damage must be notified to us in writing as soon as possible and in any case within 30 days of the delivery date, or of the date the goods should have been delivered. The claim must quote the consignment note number and be supported by the proof of delivery and the invoice for the goods.
Claims notified after that period may not be entertained.
12. Governing law
These terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts at Jaipur, Rajasthan.
